DiskPatch and DIY DataRecovery License information

 

DIY DataRecovery distinguishes 2 main license types for DiskPatch usage:
- Home use (single user, included when purchasing DiskPatch) :
Grants the customer the right to install and use the software on Personal Computers that are leased and/or owned by the customer.
The software may not be used in a commercial environment and/or to provide commercial services.
This license is bound to 1 individual (a home user).
- Professional (single user, included when purchasing DiskPatch Professional) :
Grants the customer the right to use the software on Personal Computers that are not owned by the customer. The software may be used to provide service, commercial or non-commercial.
The software may be used in a commercial environment.
The software may be used on Servers (Windows NT/200X).
This license is bound to 1 individual (a service representative or a system administrator).

License Agreement


This license is a legal agreement between you and DIY DataRecovery.
This agreement stipulates the following:


- General

By using the software you have indicated you accept the license terms.

You can use the demo version(s) of the application(s) to determine if the application(s) can recover your data. Once you have determined it/they can fully or partially recover your data and you intend to use the application for said recovery, or if you intend to keep the software for later use, you must purchase and register the application(s).

A license is not transferable.

One single user license permits you to use the licensed application(s) on all computers that you, as one individual private/home user, own and/or lease and to electronically store the application(s) for future use.

The single user license may not be used in an environment where data recovery is performed as a commercial service, unless you obtain a technician license.

If any DIY DataRecovery software application is used in any of the following environments;
- Governmental
- Educational
- Commercial Data Recovery services related
you are required to purchase a technician license for that particular application.

You are allowed to redistribute the demo version(s) of the application(s) as long as you do NOT charge for the application itself. In addition it is not permissible for you to change the distribution format (i.e., .ZIP file) or the contents of the distribution in any way.

You are NOT permitted to redistribute the licensed application(s) and/or accompanied documentation.

DIY DataRecovery will provide registered users with technical support through use of the online forum, Website FAQs or e-mail. All aspects of product use will be supported, within reasonable boundaries; the support staff will determine boundaries if needed. An initial support request must be submitted through the online forum.

The purchased license is not a contractual agreement between DIY DataRecovery and the licensed holder for guaranteed data recovery. DIY DataRecovery does not guarantee that the software and/or documentation will meet your requirements.

DIY DataRecovery can not and will not guarantee a positive data recovery outcome. Advice given through documentation, DIY DataRecovery’s website, or email comes 'as is'. DIY DataRecovery can not and will not be held accountable or responsible for any damage that is inflicted by the person(s) using the information and/or applications we supply.

DIY DataRecovery may use forum or email correspondence for assembling online recovery guides or FAQ documents.

It is not permissible for any person(s) to decompile, disassemble or change the application code in any way.

DIY DataRecovery endeavors to develop software to the highest possible standards but we can not be held responsible and therefore accountable for any limitations and/or bugs.

- Updates / Upgrades

If updates are available, DIY DataRecovery will make these available through the website.

An update is a newer version of the application that fixes bugs and/or adds functionality that doesn't cause the number in front of the period to change. For example, the application version changing from 1.1 to 1.2 is considered an update; 1.2 to 2.0 is considered an upgrade. Although DIY DataRecovery has a history for making upgrades available free of charge for registered users, it does not guarantee this practice indefinitely.

DIY DATARECOVERY DOES NOT WARRANT THAT THE SOFTWARE IS ERROR FREE.

DIY DATARECOVERY DISCLAIMS ALL WARRANTIES WITH RESPECT TO THE SOFTWARE, EITHER EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT OF THIRD PARTY RIGHTS.

NO LIABILITY FOR CONSEQUENTIAL DAMAGES. IN NO EVENT SHALL DIY DATARECOVERY BE LIABLE FOR CONSEQUENTIAL, INCIDENTAL OR INDIRECT DAMAGES OF ANY KIND ARISING OUT OF THE DELIVERY, PERFORMANCE OR USE OF THE SOFTWARE, EVEN IF DIY DATARECOVERY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT WILL DIY DATARECOVERY'S LIABILITY FOR ANY CLAIM, WHETHER IN CONTRACT, TORT OR ANY OTHER THEORY OF LIABILITY, EXCEED THE LICENSE FEE PAID BY THE BUYER.
